Terms of Use

These Terms of Use are an agreement between you and ETERNI DIGITAL S.R.L. ("Eterni", "we", "us"), a company registered in Romania at Șos. Chitilei 242D, Corp 3, Et. 2, Ap. 99, Sector 1, București, Romania (Trade Register J2026047042001, Tax ID 55324616). They apply when you use the Eterni app. Questions, complaints, or claims about the app should go to hello@eterni.eu, not to Apple.

1. What Eterni is

Eterni stores a Legacy, meaning the encrypted messages, memories, and records you choose to keep, and lets you name Beneficiaries who receive it after you die, through a release ceremony you configure in advance.

2. Your account

You need an account to use Eterni. You are responsible for keeping your sign-in details and your passphrase safe. If core app functionality supports it, you may delete your account at any time from Settings. See the Privacy Policy for exactly what that does and how long it takes.

3. The irreversible part

Your Legacy content is encrypted on your device with a key that stays on your device. Your passphrase and your Legacy Key each unlock that key, so either one opens your content. If you lose both, your data cannot be recovered, not even by Eterni. We do not hold a spare key, and there is no support ticket that gets it back. Write your passphrase and Legacy Key down somewhere safe before you rely on Eterni.

4. Beneficiaries and the release ceremony

When you add a Beneficiary, you are telling us who should receive your Legacy, and you are agreeing to what will be shared with them after your death is confirmed. You can review and change your Beneficiaries at any time while your account is active. Once a release is triggered and completed, it cannot be undone.

5. Subscription

Eterni is offered as a yearly auto-renewable subscription (currently $49.99 per year, or the local equivalent Apple shows you) through the App Store. Apple is the merchant of record: your payment, billing, and refund requests are handled by Apple under its own terms, not by us. Your subscription renews automatically unless you cancel at least 24 hours before the renewal date, in your Apple ID account settings. We do not have access to cancel it for you.

If a renewal payment fails and stays unresolved, here is what happens to your data (also described in the Privacy Policy): your vault goes read-only immediately, but you can still export everything for free. We will remind you at 30, 60, and 90 days, with a final warning at day 113. If nothing changes by day 120, we permanently delete your encrypted content. This clock stops automatically if there is an open Beneficiary claim or a death report on your account.

6. What you agree not to do

Do not use Eterni to store or send anything you do not have the right to store or send, to impersonate someone else, or to try to access another person's account or Legacy without authorisation.

7. No warranty from Apple

This agreement is between you and us, not with Apple, and Apple has no obligation to provide any maintenance or support for the app. If the app fails to conform to any warranty, you may notify Apple and Apple will refund the purchase price to you, if applicable. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. We, not Apple, are responsible for addressing any claims from you or a third party relating to the app or your use of it, including product-liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising from consumer-protection or similar legislation.

8. Intellectual property

We, not Apple, are responsible for addressing any claim that the app or your possession or use of it infringes a third party's intellectual property rights.

9. Legal compliance

You represent that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.

10. Limitation of liability

To the extent permitted by Romanian law, Eterni's liability for any claim relating to the app is limited to the amount you paid for your subscription in the twelve months before the claim arose. We are not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited under Romanian or EU law, including liability for our own gross negligence or wilful misconduct.

11. Third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce them against you.

12. Changes

We may update these Terms as the product changes. If a change is material, we will tell you in the app or by email before it takes effect.

13. Governing law

These Terms are governed by Romanian law. Any dispute that cannot be resolved directly will be subject to the jurisdiction of the Romanian courts, without prejudice to any mandatory consumer-protection rights you have in your country of residence under EU law.
